MAJOR RESPONSIBILITIES





  • Serve as Association Collateral Custodian to ensure applicable documents are properly completed, executed and in compliance with all legal, regulatory and internal requirements. Work with AgCountry and AgriBank staff to develop and monitor necessary reports and controls to ensure compliance with regulatory and Association standards.


  • Serve as a resource within the Legal Department to research, provide analyses and opinions and develop procedures, processes and forms and provide guidance and training to staff, on topics including but not limited to Borrower rights, Construction Processes, Environmental Regulations, Flood Insurance, Consumer Lending Laws, Government Regulations, Notary, Records and Record Retention, Real Estate, Collateral, Loan Documentations and other legal and compliance areas.


  • Assist AgCountry Legal Department in the development and maintenance of the Legal Loan Closing manual, ensuring compliance with policies and regulations. Develop communication and/or training in conjunction with implementation of new policies, procedures and regulations.


  • Review and advise on borrower entity documentation, complex collateral scenarios, legal descriptions and provide training to team members upon request.


  • Assist the General Counsel and Assistant General Counsel with drafting and reviewing custom loan documents, forms, contracts, and other legal documents and completing entity reviews.


  • Develop and oversee the delivery of training for compliance, forms, process and procedures under areas of responsibility.  Work with Lending Services, Consumer Lending, Credit, and Legal Departments to develop standards in compliance and documentation and monitor for adherence to standards.




REQUIRED KNOWLEDGE & EXPERIENCE





  • Bachelor’s degree in Paralegal, Ag Finance, Library Science, Business or related field; or equivalent, related work experience.


  • Knowledge of legal, commercial secured lending and lease terminology, title insurance, real estate law, the Uniform Commercial Code and collateral documentation.


  • Ability to function in and promote a team atmosphere, while getting work done in an independent, self-motivated manner.


  • Self-starter who is organized and detail oriented.


  • Demonstrated skills in training, or trained as an educator, and in problem solving with minimal supervision.


  • Strong oral and written communication skills.


  • Strong interpersonal relations skills.


  • Ability to effectively communicate understanding of the industry and Association policies to internal and external contacts
