Notable cases
  • O'Melveny currently represents Bank of America in several multibillion-dollar cases, wherein the Bank was named as an alleged "successor-in-interest" to Countrywide Financial Corporation. The claims in the suit attack the merger of Countrywide and the Bank's efforts to allow Countrywide as a distinct and separate corporate identity.
  • O'Melveny is currently continuing its defense of Lennar Corporation, which is one of the country's largest homebuilders. This case is a high-stakes litigation matter. In the spot are Lennar's partners Nicholas Marsch III, and Barry Minkow, who is a self-styled sleuth and convicted scam artist. Lennar was not only cleared in the case, however, Marsch was ordered to pay Lennar more than US$55 million in damages. However, Marsch was not contended and used bankruptcy to file charges against Lennar. He also utilized the services of Minkow to publicly malign Lennar. O'Melveny sued Minkow for libel and extortion, and he was forced to plead that he had manipulated Lennar's stock. This case is prominently featured in a January 2012 issue of Fortune Magazine.
  • In 2011, O'Melveny prevailed in a seven-and-a-half year court battle that was brought by Rambus Inc, against their client SK hynix, which is the world's second largest maker of computer memory chips. Rambus claimed that the rivals and their co-defendant Micron Technology had conspired along with engaging in criminal conduct to prevent the RDRAM proprietary memory technology of Rambus to become the standard computer memory technology countrywide. This case was widely called as the defense verdict of the year in 2011.
  • O'Melveny has successfully prevented the last minute effort of the Airline Pilots association (ALPA), which is the Union representing the pilots at United, to derail an important phase of United Airline's revision to flight operations. This is in connected with United's Merger with Continental Airlines. ALPA had sued United just a few days before the implementation of the new flight operations policies. It had sought a Temporary Restraining Order (TRO) along with a preliminary injunction to postpone the implementation. They had alleged that the computer-based training on the procedures was inadequate. However, in light of the TRO victory in favor of United, the union has agreed to dismiss the entire case.
